POSH & HR Complaints

POSH & HR Complaints — Stand Up Against Workplace Harassment

In every professional environment, safety and respect are non-negotiable. Yet, many employees—especially women—suffer in silence due to workplace harassment, toxic culture, or unresolved HR issues.

The POSH Act (Prevention of Sexual Harassment at Workplace Act, 2013) was introduced to protect individuals from sexual harassment at the workplace and to provide a structured redressal system. But filing a complaint under POSH or addressing HR-related grievances can feel overwhelming without proper guidance.

At Bank Samadhan, we provide confidential support and professional complaint drafting for individuals facing workplace harassment, discrimination, or unfair treatment. We guide you through your legal rights and help you escalate your issue the right way.

What Qualifies as Sexual Harassment or HR Misconduct?

The POSH Act clearly defines sexual harassment and mandates internal complaint mechanisms. Apart from this, general HR complaints such as hostile behavior, wrongful termination, or unethical practices are also actionable.

Here are examples of violations we help address:

  • Unwanted physical contact or advances

  • Sexually colored remarks or jokes

  • Inappropriate texts, emails, or social media behavior

  • Being denied maternity leave or forced to resign

  • Unfair termination, demotion, or appraisal bias

  • Retaliation after reporting complaints

  • Internal Committee not responding to a formal POSH complaint

These are not just policy violations — they are legal offenses under Indian law.

POSH & HR Complaints – FAQs (Frequently Asked Questions)

Q1. What is POSH?
POSH stands for Prevention of Sexual Harassment at the workplace. It’s a law that mandates employers to create a safe working environment and set up an Internal Committee (IC) to handle complaints.

Q2. Who can file a POSH complaint?
Any woman employee, intern, contract worker, or visitor who faces sexual harassment at a workplace can file a complaint under POSH.

Q3. What is the time limit for filing a POSH complaint?
A complaint should ideally be filed within 3 months of the incident. However, in certain cases, delays are allowed with valid reasons.

Q4. What if the company has no POSH committee?
That’s illegal. Every company with more than 10 employees must form an Internal Committee. You can file a complaint to the Local POSH District Officer.

Q5. Can I file anonymously?
Not under POSH. But you can seek professional support to frame and submit the complaint confidentially, with legal safeguards.

Q6. What if my complaint is ignored?
You can escalate it to the labor commissioner or State Women Commission, or even file an RTI. We can help with this step.

Q7. Can men file POSH complaints?
No. POSH applies only to women. However, male employees can file HR grievances or complaints under labor laws for abuse, threats, or misconduct.
